Description

Our Assistant City Attorney III, Water or Senior Assistant City Attorney, Water provides legal counsel to the City on water law issues, primarily through representation of the Water Division of the City’s Water & Power Department. Responsibilities include performing legal research, writing and reviewing contracts, advising on water acquisition and strategizing on civil and water court litigation with outside counsel, drafting ordinances and resolutions, preparing legal documents relating to water acquisition and providing legal advice on other miscellaneous municipal law items. Provides legal
representation and advice to the City, City Council, City boards and commissions, and City staff; and to perform such other duties and responsibilities as may be assigned by the City Attorney.

The salary range for this position is $144,974 - $202,963 annually, depending on qualifications and experience.

Essential Functions: Assistant City Attorney III, Water

• Ability to perform legal work in all phases of water law.
• Ability to write coherent and concise legal pleadings, opinions, briefs, municipal legislation, correspondence and memoranda of law including real estate and water law.
• Address legal issues arising out of routine water, wastewater and sewer operations, as well as those related to capital projects.
• Responsible for legal matters associated with utility easements, utility location and conflicts, compliance with utility construction standards, regulatory compliance (EPA, CDPHE, Army Corps, State Engineer’s Office), code interpretations and revisions.
• Drafts intergovernmental agreements for water interconnections, substation maintenance, mutual aid, and water quality studies.
• Provides legal advice on development related matters, such as oversizing agreements, reimbursement agreements, wastewater lift stations, water booster stations, and water rights matters, including water bank deposits and agreements.
• May attend City Council meetings and City management team meetings for the City Attorney as needed.
• Assists in training of other attorneys and office support staff
• Interprets federal, state and local laws, rulings and regulations.
• Provides legal advice to City Council, City departments and officials, and various City board and commissions
• Prepares contracts, ordinances, resolutions and other legal documents
• Reviews City contracts and other legal documents for legal sufficiency and potential legal implications
• Identifies potential and actual legal issues raised by City policies and practices, and recommends actions to address such issues
• Represents the City in negotiations and in administrative and court proceedings
• Performs professional legal work carrying the highest levels of volume, complexity, consequence, autonomy and responsibility
• Performs legal research, write briefs, memorandum and opinions of law for the City Attorney, City Council, City boards and commissions, City staff, and in conjunction with litigation activities
• Keeps the City Attorney informed of matters being handled as required
• Attend meetings of boards and commissions as assigned
• Ability to work independently with minimal supervision
• Performs other duties as assigned.

Essential Functions- Senior Assistant City Attorney, Water (in addition to Essential Functions listed above): May perform supervisory functions within the City Attorney's Office.

Qualifications

Required Education: Law degree from an ABA-accredited U.S. law school

Required Experience (Assistant City Attorney III, Water) : 6 years of experience in general municipal law and/or related areas such as land use, real estate, sales and use tax, elections, civil litigation, and/or other local government law. Must have 4 years experience in water law.

Required Experience (Senior Assistant City Attorney, Water) : 7 years of experience in general municipal law and/or related areas such as land use, real estate, sales and use tax, elections, civil litigation, and/or other local government law. Must have 5 years experience in water law.

Certifications

• • Valid driver's license preferred.
  • Must be licensed to actively practice law in the State of Colorado and be in good standing with the Colorado Supreme Court.

Knowledge, Skills, and Abilities: Assistant City Attorney III, Water

• General knowledge of the law.
• Specific knowledge of water resources law, as well as, civil litigation, water law and court procedures, real property law, and similar areas.
• General knowledge of municipal organization and operations.
• Skilled in legal writing and research.
• Ability to participate in team problem solving.
• Strong analytical skills.
• Ability to effectively communicate both verbally and in writing.
• Ability to use word processing and presentation software, and to perform on-line legal research.
• Ability to work independently in protecting the legal interests of the City and in supporting the goals and objectives of the City Council, City Manager and City Attorney.
• Ability to perform with integrity; demonstrate honesty and sensitivity to ethical issues; and avoid actual or apparent impropriety and/or conflicts of interest.
• Exercise appropriate judgment, often under pressure, consistent with the highest levels of volume, complexity, consequence, autonomy and responsibility attending the position.
• Establish and maintain effective working relationships with City staff and officials, co-workers and the public, and deal with problems timely, effectively, courteously and tactfully.

Physical Demands: Frequent minimal physical effort typically found in clerical work. Primarily sedentary, may occasionally lift and carry light objects. Walking and/or standing as needed and minimal.

Working Environment: Frequent exposure to routine office noise and equipment. Occasional exposure to hazards typically found in general office environments where there is rarely to no exposure to injury or accident.
